You can say 'Yes', but it will trigger unnecessary questions from IO. I am not sure about the consequences. If I were you, I would say NO as its not full time course and not going to change the status to F1. I beleive you should say 'YES' only if you change to F1 visa in the future.

I, a July 2 filer, got receipts last week. EADs came on the weekend. No APs yet. Seems like USCIS is still very much backlogged. Taking infopass etc is unlikely to help much. Best is jus wait for another 2-3 weeks. Best of luck...

I might send them a couple of recommendations. One of them has to do with issuing receipt notices the same day or next day instead of waiting for weeks by using bar-code technology in forms. I will post a copy of email here once I send it.

I agree with you that you need to go with lawyers who are really specialized in immigration especially when the case is complicated.
I know a person whos company lawyer screwed up the case. (They are from a very reputed law firm). Then she went with Murthy, they did a great job and got it done for her. They charged her a lot but it was worth it.
So get the best out there. It may be expensive but if it fixes your case its worth it.

your old 140 will still be valid even if the new one is deneid and as long its not withdrawn or revoked by USCIS. You should be able to get 3 yrs H1 based on your approved 140. Hope this helps.

You could travel out and enter into US using your old visa stamp assuming that you enter before your old visa stamp expires. However show the new approved I-797 H1B petition at port of entry and they MOSTLY will give you a new I-94 valid till the expiration of new I-797 approval.

What I understand is that, your spouse can apply for H1, but not "change of status" while on EAD/adjustee. The establishment of H1 status for your spouse is possible only via an entry using H1 visa.
So your spouse can wait in USA for the H1 approval notice and then travel outside USA for consular processing.
Anyway, it may not worth all this pain, since she can continue using EAD.

I would suggest to apply for the extension now and atleast carry a application receipt with you. And if you are planning to enter the county in July - Sug time, frame, I would suggest that you carry the approval notice as well.
I had the same issue with H1B. Even through my H1B was valid but it was expiring within a months time when I was re entering US after a business trip. I was suggested by my lawer to carry the H1B extension approval notice.

I am having the same issue.Applied AP online on 1/10/11.Got receipt no and Application as PDF.I have the Receipt no and sent all supporting document with LINXXXXXXXX no.But I have been trying to add the case no to my profile and it says not found.I am not sure what can I do or wait for more days.

Pineapple, although I dont have a solution to your problem I can definitely say that something is better than nothing. The senate dont have a problem with legal immigration, as long it is legal. If we can get our EB provisions as a part of this bill, most of them will be happy. There will quirks that can apply to immigrants as well, but that has to be addresed by the part of overall nature of the bill.
