It depends on job duties mentioned in the LCA. For example, you might be a solution architect and this comes with experience. Some roles could be guiding junior folks, interviewing people, reviewing work done by others, project management, vendor management etc ... Essentially you need to prove your 5-year experience is worth and that is what is needed to fill your current role. Prove that this can not filled by a plain BS graduate with no experience or even a guy/girl with MS degree and no experience. DOL might be thinking why not just a BS degree or BS + 5 years = MS degree.

My PD is current for 12 months (from Oct 2007) .
Today i got reply for my June 2008 service request, saying my back ground check is not cleared :mad:
I know from Infopass that my NC is cleared long back.:)
If your PD is not current cant do any thing but PD is current, contact your local congressman.

I opened a service request with USCIS when my I485 was current in 09/08 and i got response saying that still investigation into my background remains open, so the case is not yet ready for decision. I filed my I 485 in August 2005 and in july 2007(then my file was current) also i was told that the background check is still going on.
Now we know that if it has been more than 180 days after we file I485, no need to wait for background check to process the petetion. My intention is to get my file out of this loop by the time PD becomes current. If any one had this issue and got it resolved, please advise me how i can handle it.

When it comes to the community organizing and support activities for the comprehensive immigration reform legislation, there are hundreds of organizations that organize, network, and mobilize the immigrants in support of the issues involving the difficult issues of legalization of illegal aliens. However, the same is not true with the employment-based immigration reform issues. The lobbying and organizing and support of these issues rely heavily on the employers, businesses, and academic institutions such as competeamerica. Without doubt, the employers should be the most effective and powerful groups to pressure the Congress, President, and other players in the political process.
However, it is time that the immigrants themselves also participate in a similar effort to share information, issues, and supporting activities. Obviously, the first move is to organize and build a network throuhout the nation and the world, and along with the networking, other support activities must be conducted and expanded. There are not too many immigrant groups that are focused on the employment-based immigration reform issues. Currently, a website of www.immigrationvoice.org is launching this campaign and attempting to organize and network in the employment-based immigrant communities. This reporter urges the foreign professional workers to visit and join this group to help an activities of side-kick from the standpoint of stakeholder foreign workers in support of the employers and their support groups. "Networking" will create a power in the political process.

Only one good thing I can see on PBEC efficieny is atleast they are processing cases from Nov 04. Which is really really a good news based on the pace they were at last year same time.

My company just received a latter titled as "Confirmation of Withdrawal" which states that your Labor Processing Application filed in November xx, 2004 is withdrawn, as requested by your letter dated August xx, 2004.
Isn't that amazing that they are so swamped and desperate in eliminating the backlog that they do not know the chronological order of the dates also?
Backlog Elimination Centers' are the biggest waste of Taxpayers Money, I think.

Hi,
I have a pretty simple question.
A person decides to change employers, moving from company A to company B. It's been 180 days after 485 filing.
Question: what does company B have to do to legally take this person on as full time employee? Is the process any different than taking any other american resident employee? The way I understand is it is not any different.
Please advise,

What would be fee for the old folks who filed I-485 in June?

Hi!
My H1B was filed on April 1st 2007 at Vermont Service Center while i was in India and got selected in the lottery. I came to US on May 13th on H4 visa (I 94 valid till July 18, 2008) and still my papers were under process.
On June 1st, 2007 the approval notice was sent to my employer.
Oct 1st, 2007 they applied for my change of status and on 19th it was returned back as a check for 500$ was not included.
Kindly let me know if we could go for a H1B Transfer and change of status simultaneously with a new employer.
Within what time line i need to apply for the same.

Hi everyone,
I applied for my I-131, I-765 and I-485 together under EB-2 category on the 13th of September 2010. I got approval letters for both I-131 and I-765 by the 9th of November 2010. My wife and I also received our EAD cards and travel documents. But today I got another set of receipts for both I-765 and I-131 with rfe for photographs. The receipts number are different in both the previous and new receipts and the new ones are showing up in pending state on the USCIS website.
Please let me know what can be the reason I got these duplicate receipts and what should be the next steps.

USCIS - Left hand does not know what right hand does and vice versa.

I would suggest you to switch to EAD. There is no reason for you stick to H1-B anymore.

I am just wondering if notice date and receipt date combination means anything in terms of when the EAD will be processed?
I think so since lots of people with receipt date same as mine, who have their EADs approved had an earlier notice date .
Also other people with same notice date with EADs approved had an earlier receipt date.
Just trying to gather some evidence here.

Reliable information from my friend's lawyer says that the cap for this year is NOT reached in the 1st one week. I think this means all applications filed in first week will be processed.
