with 90 days validity and I have not seen my receipts or checks cashed yet.
My lawyer replied to 90 day validity. He mentioned that if at time of sending documents if the check was valid and had not expired then application should be accepted.
Also he mentioned that with so many procedural errors being overlooked in this last July visa bulletion, this has to be looked over, since this is not a problem of candidate sending documents.
And there is nothing one can do about it, so i am thinking it will be alright.
We will be fine.

You need to be present in US at time of applying for the extension and when its approved. Said that in your case I think it would be fine to start H1B extension process after you are back. May be to be safe you can try doing it premium(if company is ready to spend extra money) as it gets done usually in less than a month.

If your application gets approved before/on 30th June you will get 1 year EAD. If this happens after/on 1st july you should get 2 years. I am in same senario.

Hello, I am on H1B with an employer with dates from sep 2005 to sep 2008. I am amending my petition (with a new lca) as well as extending it for the same company. The amendment date will be from April 1st.
Now my question is shd my extension (with amendment) be from April 2008 to April 2011 or can it be for the remainder of 6 years that is April 2011 to Sep 2011. Please let me know. Thanks

My spouse and myself are called for 485 initial interview, have couple of questions.
1) Do I need to take Affidavit of Support docs(form I 864), my 485 is employment based and not family based(I am the primary applicant)
2)Do I need to take Original I 140 and Original Labor approved doc
also please let me now if some one have been to such interviews and if there are any suggestion?

My application for an H1B change of status has been denied. I am an F-1 student from Colombia and I was offered a job from THe CDC at Atlanta. According with the USCIS report, the petition was denied because I am going to be hired for a staffing company and not directly for the CDC. It will be possible to appeal the desicion ? If yes, what will my sponsor company need to be succesful with this appealing ?

My PD is 04/2002 and RD is 18/June/2007, EB3 India. EAD approved and fp done in Aug.
There are no soft LUDs on my 485 after 7/17/2007. What does this mean? Is there a way to check if I am stuck in name check?
I see many people with later RD and PD getting soft LUDs. Is anyone else in the same boat? Please advice..

So now we are tracking Soft LUDs as well :)
Not getting a soft LUD is the norm. It just means your case was not an exception and you can't expect any miracles ..Yet! But Getting LUDs is not guaranteed to result in GC approval either. So please stop worrying about every little thing and enjoy your life... (Like I'm doing visiting this forum every now and then ;)

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. Other gurus can answer in a detailed manner. I am going to very short. Chinese Eb3 have filed for an injunction stating that they need to be allocated visa numbers because in 2008 and 2009 they were overlooked because DOS could not count the inventory of EB3 properly.
DOS replied that this kind of injunction would harm other countries ppl. DOS is allowed by law to make reasonable estimates in progressing and degressing priority dates. If some ppl are left behind they cannot do anything.
Here is the part of the law which states that DOS has the authority to do reasonable estimates of priority dates and this is what was stated in the DOS response to the injunction
Congress has expressly
provided that in allocating visa numbers, the Department of State may “make reasonable
estimates.” 8 U.S.C. � 1153(g). In relevant part, Section 1153(g) states:
For purposes of carrying out the Secretary’s responsibilities in the orderly administration
of this section, the Secretary may make reasonable estimates of the anticipated number of

My and My Spouse I-485 & FP, EAD and AP all checks cleared yesterday and I found the Receipt Number on Back of the Cleared Checks. But when I check the status on the USCIS System. It says check the receipt Number. Is any one face this type of problem....? Please advice. Thank you.
